Are you up-to-date with your data protection responsibilities as an employer? When the GDPR was introduced five years ago, there was limited guidance available on what the documents should include and the steps that needed to be taken to comply with the legislation.
Unfortunately, many areas of uncertainty persist but since 2018, the ICO has published additional guidance and the case law has started to trickle through as well as businesses have tested what the regulations really mean in practice.
Two common issues we see are where businesses don’t have the correct documents in place for job applicants, volunteers and subcontractors and don’t have the correct risk assessments and data protection impact assessments in place to process DBS checks, CCTV and tracking of company vehicles and computers.
Additionally, post-Brexit regulations and recent case law have resulted in changes to how you can transfer personal data outside the UK.
